1. Scope of application

The following General Terms and Conditions apply to all orders placed via our online shop.

2. Contracting party, conclusion of contract

The purchase contract is concluded with AK MEDIA.

By placing the products in the online shop, we make a binding offer to conclude a contract for these articles. You can initially place our products in the shopping basket without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the order process. The contract is concluded by clicking on the order button to accept the offer for the goods contained in the shopping cart. Immediately after sending the order you will receive another confirmation by e-mail.

3. Contract language, contract text storage
The language available for the conclusion of the contract is German and English.

We save the contract text and send you the order data by e-mail. You can view the general terms and conditions at any time here on this page. For security reasons, your past orders are no longer accessible via the Internet.

4. Terms of delivery

All offers are delivered by us from 25€ free of charge. 

We only deliver by mail order. Unfortunately, it is not possible to collect the goods yourself.
We ship all articles worldwide free shipping from $28. 
The delivery time is between 14 and 49 days due to the partly high demand of the products and international production. 
Our delivery time applies from the time when we have received a complete order (including all necessary order and address details). Missing data for the dispatch of the commodity are inquired afterwards and can delay thus the time of the dispatch.

5. Payment

The following payment methods are available to you in our shop:

Credit card

When you place your order, you also send us your credit card details.
After your legitimation as a legitimate cardholder, we request your credit card company to initiate the payment transaction immediately after the order has been placed. The payment transaction is carried out automatically by the credit card company and your card is debited.

Bank transfer

With the selection of the bank transfer, the data such as the amount to be transferred or the IBAN after the order on the confirmation page will be displayed to you and also sent by e-mail. If you successfully complete this request, we will then send the item(s) to you.

PayPal, PayPal Express 

During the ordering process you will be redirected to the website of the online provider PayPal. To be able to pay the invoice amount via PayPal, you must be registered there or register first, legitimize with your access data and confirm the payment order to us. After placing the order in the shop, we request PayPal to initiate the payment transaction.
The payment transaction is carried out automatically by PayPal immediately afterwards. You will receive further information during the ordering process.

 

6. Transport damage

If goods with obvious transport damage are delivered, please complain such errors as soon as possible to the deliverer and contact us immediately. Failure to make a complaint or contact us will not have any consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance.

7. Warranty and guarantees

Unless expressly agreed otherwise below, the statutory liability for defects shall apply.
The limitation period for warranty claims for used goods is one year from delivery of the goods.
The above restrictions and shortening of deadlines do not apply to claims based on damage caused by us, our legal representatives or vicarious agents.

  • in the event of injury to life, limb or health,
  • in case of intentional or grossly negligent breach of duty as well as fraudulent intent,
  • in the event of breach of material contractual obligations, the fulfilment of which is essential for the proper performance of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations)
  • within the framework of a guarantee promise, if agreed or
  • to the extent that the scope of application of the Product Liability Act has been opened up.

8. liability

For claims due to damages caused by us, our legal representatives or vicarious agents, we are always liable without limitation.

  • in the event of injury to life, limb or health,
  • in case of intentional or grossly negligent breach of duty,
  • in the case of guarantee promises, if agreed, or
  • to the extent that the scope of application of the Product Liability Act has been opened up.

In the event of breach of material contractual obligations, the fulfilment of which is essential for the proper performance of the contract and the compliance with which the contractual partner may regularly rely, (cardinal obligations) due to slight negligence on our part, on the part of our legal representatives or vicarious agents, liability shall be limited in amount to the damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.

9. deliveries from abroad

All deliveries are delivered duty unpaid and untaxed from non-European countries. With the purchase of the goods you are considered an importer and are responsible for any customs and tax arrears.

10. dispute settlement

The European Commission provides a platform for online dispute resolution (OS), which you can find here http://ec.europa.eu/consumers/odr/. 
We are not obliged or prepared to participate in a dispute resolution procedure before a consumer arbitration board.

We ship all articles worldwide free shipping from $28.

Where can I view the order status?

We will process your order within a maximum of two working days.
Once your order has been submitted to the shipping company, you will receive an email notification where you can track your order.

Cancellation Terms

Right of cancellation

You have the right to revoke this contract within 14 days without giving reasons. Commercial orders are excluded from revocation. Costs for the return in the case of a revocation are borne by the buyer.

The revocation period is 14 days from the day on which you or a third party named by you who is not the carrier have taken or have taken possession of the last goods.

In order to exercise your right of withdrawal, you must inform AK MEDIA, Fleischmarkt 14/27, 1010 Vienna, Austria, info@cuddle.community, of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter, fax or e-mail sent by post). You can use the attached model withdrawal form, which is not mandatory.

In order to comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the expiry of the revocation period.

The return of the product in the case of a revocation takes place at the expense of the buyer. For the return of defective received or wrongly delivered goods we send a return sticker on request. Shipments that are not prepaid will be rejected by us. 

Consequences of revocation

If you revoke this Agreement, we shall repay to you all payments received from you, excluding delivery charges, immediately and no later than 14 days from the date on which we received notice of your revocation of this Agreement.

For this refund we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund.

We may refuse to refund until we have received the Goods back or until you have provided evidence that you have returned the Goods, whichever is earlier. If the goods are not in their original condition or have been used, we can make the refund invalid.

You must return or hand over the goods to us unopened immediately and in any case within 14 days of the day on which you inform us of the revocation of this contract at the latest. The deadline is met if you dispatch the goods before the expiry of the 14-day deadline. You shall bear the direct costs of returning the goods. They shall be liable for any depreciation of the goods only if such depreciation is due to handling of the goods which is not necessary to examine their nature, properties and functionality.
